Our slip and fall lawyers in Detroit have the experience, specialized knowledge, and skill to help you recover the pain and suffering compensation and money damages you are legally entitled to after a slip and fall accident that has left you injured or has taken the life of your loved one.

Getting Help After a Slip and Fall Accident

If you have been injured in a slip and fall accident – or if fatal injuries have taken your loved one’s life – you need the help of an experienced attorney who specializes exclusively in getting full compensation for people like you.

Your attorney will help you win the best possible settlement in your case by identifying all the responsible parties, uncovering all the financial assets and insurance policies they can use to compensate you for your injuries and damages, and using the evidence and the law to prevent them from avoiding their legal liability to you.

Negligence in a Detroit Slip and Fall Case

To prove your case for negligence in a Detroit slip and fall case, you must prove four elements: (1) the property owner or business where you slipped and fell owed you a duty to protect you from dangerous conditions on the property, (2) the property owner or business breached its duty by failing to protect you, (3) the owner’s breach of its duty caused your injuries, and (4) you suffered noneconomic damages such as pain and suffering and mental anguish and economic damages such as medical bills and lost wages and earnings if your injuries prevented you from returning to work.

Property Owner’s Duty Under Michigan Law

Michigan’s premises liability laws provide that property and business owners have “a duty to exercise reasonable care to protect” invitees – such as customers or people who have been invited onto the premises to do business with the owner – “from an unreasonable risk of harm caused by a dangerous condition of the land.” (M Civ JI 19.03)

To carry out this duty, the Michigan Supreme Court in Stitt v. Holland ruled that property owners must “make the premises safe” for their customers by (1) inspecting the premises, (2) making necessary repairs, and (3) warning their customers about known dangers and discovered hazards.

Time Limit for Filing a Slip and Fall Lawsuit in Detroit, MI

Michigan’s 3-year statute of limitations plays an important role in your ability to hold the negligent parties accountable after a slip and fall accident. It gives you three years from the date of your accident to get your lawsuit filed in court. Unfortunately, failure to file within that period of time means that your claim will be barred and any lawsuit you attempt to file will be dismissed with prejudice. In other words, failure to comply with the statute of limitations

Compensation for Slip and Fall Injuries in Detroit

The compensation you receive for your slip and fall injuries will likely include both noneconomic damages such as compensation for your pain and suffering and economic damages such as payment or reimbursement for your medical bills and the wages you’ve lost because your injuries prevented you from working and earning an income.

One of the benefits of working with an experienced slip and fall attorney is that he or she will help you seek and recover the full compensation that you are legally entitled to. Without an attorney, you could leave the money you are owed on the table.

Tim Holland, Jason Hodge, Rick Houghton and Brandon Hewitt represented me in a wrongful death case that four other lawyers turned down. They helped me secure a satisfactory result to bring closure to a very difficult time in my life. They stayed in contact with me and answered my questions. They were tenacious in my representation and treated me like family. Once a lawsuit has been filed, the settlement may not occur for one to two years, depending on the backlog of cases in the court where the lawsuit was filed.

Do most slip and fall cases settle out of court?

Many slip and fall cases do settle out of court, meaning that they settle before a lawsuit is actually filed in court.
