Michigan’s premises liability laws provide that property and business owners have “a duty to exercise reasonable care to protect” invitees – such as customers or people who have been invited onto the premises to do business with the owner – “from an unreasonable risk of harm caused by a dangerous condition of the land.” (M Civ JI 19.03)
To carry out this duty, the Michigan Supreme Court in Stitt v. Holland ruled that property owners must “make the premises safe” for their customers by (1) inspecting the premises, (2) making necessary repairs, and (3) warning their customers about known dangers and discovered hazards.
Michigan’s 3-year statute of limitations plays an important role in your ability to hold the negligent parties accountable after a slip and fall accident. It gives you three years from the date of your accident to get your lawsuit filed in court. Unfortunately, failure to file within that period of time means that your claim will be barred and any lawsuit you attempt to file will be dismissed with prejudice. In other words, failure to comply with the statute of limitations
